These Terms of Service ("Terms") are a contract between you and Kang Fahrdienst (Jugmeet Singh Kang), Westendorf 6, 38315 Schladen-Werla, Germany ("INOU", "we", "us", "our"), governing your use of the INOU mobile application (the "App") and related services. By creating an account or using INOU, you agree to these Terms. If you don't agree, please don't use the App.
You must be at least 16 years old to create an INOU account, consistent with the age of consent for online services under GDPR as implemented in Germany. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate.
INOU is a social app centered on real-world connection: you add people as friends by scanning a QR code or through in-person proximity matching ("Shake-to-Connect"), and share photos, videos, and text notes with private groups you curate ("bubbles"), persistent joinable groups ("circles"), time-boxed groups ("events"), or public creator pages ("pages"). INOU also provides direct and group messaging between connected users. We may add, change, or remove features over time.
You own your content. Photos, videos, notes, and messages you post ("User Content") remain yours. By posting User Content, you grant INOU a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and transmit that content solely as necessary to operate the App and deliver it to the audience you selected (e.g. a specific bubble, your friends list, a circle, an event, or the public for a page post). This license ends when you delete the content or your account, except where a copy reasonably persists for a limited time as described in our Privacy Policy.
You're solely responsible for the content you post and for having the rights to post it. You represent that your User Content doesn't infringe anyone else's intellectual property, privacy, or other rights, and doesn't violate the Acceptable Use rules below.
You agree not to use INOU to:
Safety note: INOU facilitates meeting people in person. We do not conduct identity verification or background checks on users. You're solely responsible for your interactions and safety when meeting anyone you connect with through the App, on or off the platform. Use good judgment — meet in public places, tell someone where you're going, and trust your instincts.
Shake-to-Connect uses your device's location, with your permission, only while you actively search — see our Privacy Policy for details. You're responsible for how you use information about your proximity to other users, and misuse (e.g. to harass or stalk someone) is a violation of these Terms and may be reported to law enforcement.
We may, but are not obligated to, review, remove, or restrict access to content that we reasonably believe violates these Terms or applicable law. We may suspend or terminate accounts that violate these Terms, at our discretion, with or without notice depending on severity. The INOU name, logo, App design, and underlying software are owned by Kang Fahrdienst (Jugmeet Singh Kang) or our licensors and are protected by intellectual property law. Nothing in these Terms grants you any right to use our trademarks, branding, or software except as necessary to use the App as intended.
INOU's backend runs on Firebase, a Google service, as described in our Privacy Policy. Your use of INOU is also subject to any applicable terms of the app store (Apple App Store or Google Play) you downloaded it from.
You may stop using INOU and delete your account at any time (see our Privacy Policy for how). We may suspend or terminate your access to the App if you violate these Terms, if required by law, or if we discontinue the service. Where reasonably possible, we'll give you notice before terminating your account for a Terms violation, unless the violation is severe or urgent.
The App is provided "as is" and "as available." We don't guarantee that the App will be uninterrupted, error-free, or available at all times, and we don't warrant the accuracy, completeness, or reliability of any content posted by users. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section limits any warranty or right that cannot be excluded under German or EU consumer protection law.
Nothing in these Terms excludes or limits our liability for intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, for fraudulent misrepresentation, or for any liability that cannot be limited or excluded under mandatory German law (including the German Product Liability Act, Produkthaftungsgesetz).
Subject to the above, our liability for damages caused by slight negligence (einfache Fahrlässigkeit) is limited to cases where we breach a material contractual obligation (Kardinalpflicht) — an obligation whose fulfillment is essential to properly performing the contract and on which you may typically rely — and in such cases is limited to the foreseeable damage typical for this type of contract. We are not liable for slightly negligent breaches of non-material obligations.
We are not responsible for the conduct of other users, for content posted by users, or for anything that happens during in-person meetings facilitated by the App (see Section 6).
To the extent permitted by applicable law, you agree to indemnify and hold us harmless from claims, damages, and reasonable expenses (including legal fees) arising from your violation of these Terms, your User Content, or your misuse of the App, except to the extent caused by our own breach or negligence.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of any protection under the mandatory law of your country of habitual residence. If you are a consumer resident in the EU, you may also bring proceedings in the courts of your own member state, and nothing here restricts your rights under applicable consumer protection law. The EU's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are not obligated and do not commit to participate in dispute resolution proceedings before a consumer arbitration board.
We may update these Terms from time to time, for example as the App's features change. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the App before the change takes effect. Continued use of INOU after a change takes effect constitutes acceptance of the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be replaced with one that most closely reflects its intent. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the App. Our failure to enforce a provision isn't a waiver of our right to do so later.
